1. Acceptance of Terms
By accessing or using AbstrMural’s website, purchasing products, or engaging with our services, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, please do not use our services.
2. Product Information and Orders
- All product descriptions, images, and pricing are provided for informational purposes. While we strive for accuracy, we reserve the right to correct errors in pricing or description and to modify or discontinue products at any time without prior notice.
- Orders are considered confirmed once payment is processed and you receive an order confirmation email. Custom commissions require a 50% deposit to begin production, with the remaining balance due before shipment.
- We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, suspected fraud, or errors in product information.
3. Intellectual Property
- All artwork, designs, images, text, and content on AbstrMural’s website are the intellectual property of AbstrMural, our collaborating artists, or our licensors. You may not reproduce, distribute, modify, or use any of this content without prior written permission.
- When you purchase an artwork, you acquire ownership of the physical piece but not the underlying copyright. The artist retains all rights to reproduce the design in other forms unless explicitly stated otherwise in a written agreement.
4. Shipping and Delivery
- Shipping timelines are estimates and may be affected by factors beyond our control, such as weather, carrier delays, or customs procedures (for international orders). We are not liable for delays in delivery.
- Risk of loss or damage to the artwork passes to you upon delivery. It is your responsibility to inspect the package upon receipt and report any damage as outlined in our Return Policy.
5. Returns and Refunds
- Our Return Policy, as outlined separately, is incorporated into these Terms. Please review it carefully, as certain items (such as custom commissions) are non-refundable.
- Refunds will be processed using the original payment method and may take 5–7 business days to appear in your account, depending on your financial institution.
6. Limitation of Liability
- AbstrMural shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services, including but not limited to loss of revenue, loss of profits, or damage to property beyond the value of the purchased artwork.
- Our total liability for any claim related to your purchase shall not exceed the amount paid for the specific product in question.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Massachusetts.
8. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website, and your continued use of our services after such changes constitutes acceptance of the revised terms. We recommend reviewing this page periodically for updates.
